Lol Personally, I wouldn't call it a "free pass" exactly....because it hurt me more than it helped by not learning that procedure.....but I know where you coming from....
I'm not sure about this as I write this but, maybe you can be tested on the 45 but the school may have had an "understanding" of sorts that the regular examiner, who has been coming for years, will not make the student test on the 45 or 90...but, I'm not really sure. It's at the examiners discretion I think if they choose 45/90 to replace the parallel....but, again, I'm not really sure.....This is kinda me hypothesizing.
When a violation by either a driver or company is confirmed, an out-of-service order removes either the driver or the vehicle from the roadway until the violation is corrected.
This topic makes the school I went to sound like the best in the world. I actually got a significant amount of driving time. 10 "shifts" of 4 hours each, well with pre trip, post trip and filling out logbook it was closer to 3.5 hours but still. the only time a trainer was shared with someone was for in yard drives and it was never more than 2 drivers sharing that 1 trainer. In such cases he would tell us what to do or he would be in the truck with one of us at a time and teach how to do what we were doing for that day or time, once he felt we were good he would go to the other guy and do the same. As for the road drives it was 1 trainer 1 student 1 truck... none of this 3-4 students in 1 truck with 1 trainer getting 30 min or so of drive time, we got our full 4 (3.5) hours of drive time.
now the classroom portion of the training that's another story... lot of outdated old material and several of the instructors are outdated on a lot of the newer laws, such as all trucks being required to have e log in the next 22 months (24 at the time) and few other things. That's ok though cause when you're a rookie driver most companies teach you the updated stuff anyways.
Sorry you had such a bad experience with your school and especially with how much they charged for that... my school was about $4500.
A written or electronic record of a driver's duty status which must be maintained at all times. The driver records the amount of time spent driving, on-duty not driving, in the sleeper berth, or off duty. The enforcement of the Hours Of Service Rules (HOS) are based upon the entries put in a driver's logbook.
Even though you've been attending this school for about a month, the actual hours you have in the truck seems minimal. I'm wondering if you can get a portion of the $6,000 refunded. Do you have a contract with this school?
Yeah, the hours are pretty paltry, not enough to really master anything. I'm working on getting out of the loan altogether. The loan for the schooling is a signature loan, meaning it didn't go through any lending institution. It's basically a "promise to pay" broken down into monthly payments with interest. So to let me out of that loan all they have to do is tear up the paperwork. (And I'm trying to strong arm them into doing just that.)
This sounds like a small company and it's probably unlikely they would spend the money to go after you legally especially since they certainly haven't fulfilled their part of the bargain.
I've been through the same kind of school, it was a local school contracted by Swift. There were days I never made it into a truck, some days there were 19 people sharing two trucks. What a waste of time. I ended up asking the President to release me, which he did. He was very nice about it and I never heard from them or Swift again. Good luck.

You got a free pass on that, when I was tested by dmv I had to perform the 45. That was 4 years ago. Interesting.
