All schools, whether public or private will have to comply with the rules put forth. Schools will have to apply, then qualify to be placed on a national registry, similar to how the medical cards are tracked.
All CDL exams will require a certificate from a nationally certified school before a CDL exam can be scheduled.

What Does The FMCSA Do?
DOT:
Department Of Transportation
A department of the federal executive branch responsible for the national highways and for railroad and airline safety. It also manages Amtrak, the national railroad system, and the Coast Guard.
State and Federal DOT Officers are responsible for commercial vehicle enforcement. "The truck police" you could call them.
