Actually I think that may depend on the company you're leased on with. You would have to review their contract to see if they have any stipulations about that. For instance, you might be able to hire someone but they may have to meet the company's minimum qualifications because you're being insured through their insurance company.
So would that be considered a company driver? Or my driver? And would I be able to go back to being a company driver ?
Honestly I'm not sure about all the details and you can be certain each company will have a slightly different setup. So it's really going to come down to the actual contract that you sign. The insurance companies will set the standards for the most part.

Most companies will have their lease set up so that you can hire another driver, but the settlement still goes to you and they will deduct out of the settlement the amount you have pre-determined with the payroll department to go to your driver. They are not a company driver, they are your driver and their pay comes out of your settlement check each week. The company must approve your driver - this is not a loophole that allows people who are not going to make the cut to get in. I happen to have a friend in this very predicament right now. He got approved to lease two trucks and the company will not accept the driver he was planning on employing. Your driver is a 1099 employee, as are you.
