This is taken from the letter I received: What is the lawsuit About: Plaintiff has alleged that Hireright violated the FCRA by failing to provide full copies of consumer's files upon request. Specifically, plaintiff alleges that Hireright excluded certain email communications it had with employers from its responses to consumer requests. Based on these allegations, plaintiff seeks statutory damages.
My paraphrasing: Hireright is not admitting to any wrongdoing but has decided to settle. Both sides want to avoid expense and uncertainties of further litigation. $460,000 will be handed over by hireright to be distributed through the class action lawsuit. Individual payments will be capped at $200. Council for the settlement class intend to apply to the court for attorney's fees not to exceed $655,000 + expenses not to exceed $60,000. Plaintiff gets an amount not to exceed $10,000.
What a freaking racket. I try to hold my tongue because I know all lawyers are not like this, but, wow...
Yeah, it is a racket, but do you think these HR dirtbags behind HireRight, or any major company out there in the world, would give a damn about you and your rights if it weren't for these lawsuits? HR and management get away with murder every day in this country, so go get yours. It's not like there will be a revolution or anything in our lifetime, so getting every little bit from "the man," whether it's HR, lawyers, management, politicians, etc, is the best you can do. Do it.
