I think it should be a nationwide 500 dollar fine and I can agree with 2 times before you lose your license. And when you do lose it you should lose it for at least a year. It is amazing the number of texting and driving people do and it would definitely reduce the number of accidents.
Jake Brake, You are too nice.I recommend a FIRING SQUAD on the second offense!
They don't reference whether or not it is a violation to make a call using a Bluetooth device because I personally see no problem with that.
I think if you are caught texting and driving, it should be a fine and lose your license on the first offense. Let's face it, there are too many vehicles and large trucks on the road for people to not be paying attentio . To what is going on around them.
To be fair, this is not including just picking up your phone to glance at it, I'm talking get about actually typing. I think that glancing at your phone for a second is no more of a distraction than changing the station on your radio, or looking at your gps, or smacking the rowdy kids in the back seat with a fly swatter......
But, for sure, if you are engaged in the actual typing...or if the phone has your attention more than what is going on around you...you're done.
Texting and driving is as dangerous as drinking and driving and it should be treated the same way. List your license for a year first offense and have the penalties increase thereafter.
Nothing infuriates me more than observing a truck driver, any truck driver texting. It must be can addiction, because basic common sense would indicate it a highly risky and dangerous thing to do.
Very difficult to enforce. That's part of the problem and the habitual texters know this.

Get caught on the phone twice while driving and you will lose your licence
"Anyone calling, texting or using an app while driving will face an on the spot fine of at least £200 ($260) and will receive six points on their licence, halfway to an automatic driving ban of at least six months."
"Already new drivers have their licences revoked if they accrue six points within two years of passing their test. That means new drivers would only need to be caught once using their mobile phone at the wheel to be forced to sit their test again."
TWIC:
Transportation Worker Identification Credential
Truck drivers who regularly pick up from or deliver to the shipping ports will often be required to carry a TWIC card.
Your TWIC is a tamper-resistant biometric card which acts as both your identification in secure areas, as well as an indicator of you having passed the necessary security clearance. TWIC cards are valid for five years. The issuance of TWIC cards is overseen by the Transportation Security Administration and the Department of Homeland Security.
