Heard a rumor that come october 26 it will be illegal to have windshield mounted gps and cell phones but I can't find anything about it anybody know any truth on this??
got a warning once for having gps mounted within the sweep area of the windshield wipers
They make a plastic disc that will mount on the dash that the suction cup will mount to.
I did a Google search for gps mounted on windshield laws. The latest entry was from 2014. There are 28 States (as of 2014) that have windshield GPS/ cellphone laws.

What Does The FMCSA Do?
A department of the federal executive branch responsible for the national highways and for railroad and airline safety. It also manages Amtrak, the national railroad system, and the Coast Guard.
State and Federal DOT Officers are responsible for commercial vehicle enforcement. "The truck police" you could call them.

The Federal Motor Carrier Safety Administration (FMCSA) issued a final rule to amend the Federal Motor Carrier Safety Regulations (FMCSRs) to allow the voluntary mounting of certain devices on the interior of the windshields of commercial motor vehicles (CMVs), including placement within the area that is swept by the windshield wipers.
Section 5301 of the Fixing America's Surface Transportation Act (FAST Act) directs the Agency to amend the FMCSRs to allow devices to be mounted on the windshield that utilize "vehicle safety technology."
In addition, section 5301 states that all windshield-mounted devices and technologies with a limited two-year exemption in effect on the date of enactment shall be considered to meet the equivalent-or-greater safety standard required for the initial exemption.
The announcement of this final rule is a nondiscretionary, ministerial action that does not require prior notice and public comment under the Administrative Procedure Act.

That sounds like they are explicitly saying it is allowed, depending on what they mean by "certain devices." It might mean things like Mobileye and Lane Alert and not GPS, can't tell.

Why couldn't they just make it simple and say no driver installed devices (cell phones, gps's, etc.) shall be affixed to the windshield in the area swept by the wipers.
It "looks like" only safety equipment (and not cell phones or GPS's). But does your "personal dash cam" fall into this category, or only your company one?
From the referenced section 5301 in the FAST Act:
(b) VEHICLE SAFETY TECHNOLOGY DEFINED.—In this section, the term ‘‘vehicle safety technology’’ includes a fleet-related incident management system, performance or behavior management system, speed management system, lane departure warning system, forward collision warning or mitigation system, and active cruise control system and any other technology that the Secretary considers applicable.
So this is only for factory or company installed stuff.
