No MRO Called But Was Told I Failed A Drug Test

A friend of mine put a word in for me with a company. I went for a pre employment drug test. I never heard anything back from company or MRO but my friend said the boss told her I failed the drug test. Is this even possible. I know mistakes happen but shouldnt I have been called. Isnt it illegal to tell someone else the results of my test.

Do you already have a CDL? If so, then you already know that a failed drug test is a huge no no. Obviously, they declined to hire you which is no surprise. I've taken pre-employment screens before (when I worked as a healthcare provider) where I was given an information sheet regarding how a failed test would be handled, procedure for requesting a retest, etc. Not so with trucking, in my experience. The tests they tend to use gives levels of substances they test for and false positives are rare.

I think I'd forget about the "but they very told me anything" (they don't have to) as well as "isn't it illegal to give out test results"..

You made your friend​ look like a fool (to her employer?) for recommending you. They probably said something as a favor​.

I'm not exactly sure whether you need to go through a SAP or not now.

CDL:

Commercial Driver's License (CDL)

A CDL is required to drive any of the following vehicles:

  • Any combination of vehicles with a gross combined weight rating (GCWR) of 26,001 or more pounds, providing the gross vehicle weight rating (GVWR) of the vehicle being towed is in excess of 10,000 pounds.
  • Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing another not in excess of 10,000 pounds.
  • Any vehicle, regardless of size, designed to transport 16 or more persons, including the driver.
  • Any vehicle required by federal regulations to be placarded while transporting hazardous materials.

SAP:

Substance Abuse Professional

The Substance Abuse Professional (SAP) is a person who evaluates employees who have violated a DOT drug and alcohol program regulation and makes recommendations concerning education, treatment, follow-up testing, and aftercare.

If you truly didnt take anything, fight it with a lawyer. my relative and a.coworker were randomly tested at a bio chem company they work at. they both came.back positive for oxycodon. he fought it by doing a hair sample instead of.the urine and the judge ordered for him to get his job back and get back pay. the lab was then invesigated and found to be.contaminating.samples.

dot has different rules than regular companies, but if you are innocent, its a big.deal and.worth straightening.it.out

DOT:

Department Of Transportation

A department of the federal executive branch responsible for the national highways and for railroad and airline safety. It also manages Amtrak, the national railroad system, and the Coast Guard.

State and Federal DOT Officers are responsible for commercial vehicle enforcement. "The truck police" you could call them.

I should have been more clear. I would not take a drug test I couldnt pass. I figure they didnt want to tell her they didnt want to hire her friend so they made something up. Is there any way I can prove this and if so would it be worth the trouble.As far as I know a MRO has to contact you for all positive tests. Yes I do have a cdl . If there was a failed test wouldnt cdl be suspended or something until I went through the steps to driving

Drug tests are highly confidential..... I pull mvr s every day and it is it not allowed to disclose it to a third party..... it is like telling a friend about your credit score

MVR:

No they have to give you the opportunity to call your friend and apologize because they just gave out confidential information......they have to communicate it with you and it is your place to communicate it with who you want...... i.e i can't talk about your credit to anyone other than you

I agree, if you're sure you haven't taken anything, fight it tooth and nail and demand answers. Sorry if I took it the wrong way. You know we often get those posts about how to beat the tests etc lol.

This whole scenario is very bizarre, and I'm having a hard time believing we have the whole story. They are required to give you the results one way or another. You should have received documentation for that test if it was a D.O.T. drug test.

They don't just not call you back if you failed. Are you certain this was a D.O.T. drug test, or was it a pre-employment test? Those two tests are handled differently, but you really don't want to fail either one.

You are going to need to pony up for an attorney if you've told us the truth, but my gut feeling is that there's some info missing here.

I am curious if this was a urine test?

Is it possible that you had taken any type of pain killers for maybe a sore back, or a tooth ache, or anything like that?

Had you smoked any weed in the last three months?

Is it possible you assumed you would get by the drug screening process, but there was a nagging thought in the back of your mind of something possibly showing up?

This was a pre employment urine test over 2 months ago. I haven't smoked weed in about 15 or 20 years. My problem is I don't even know what I was positive for. I never heard from the company or the lab. My friend just said they told her. My thinking is if they just didn't want to hire me probing anything about the test won't change that. This is a small company. By the way the sample was split into 2 and the paper work was for a for test but it was pre employment
