We had a member here, that was doing a move with a trailer from his drop, to a place to take his 10 hour break. He was not under a bill of lading, nor did he have a new load assignment (pre-plan, or dispatch) to go get. He was simply going to get his break, and wait for a load assignment. he was stopped for "speed too fast for conditions", and the trooper gave him a citation for "log falsification" instead (don't know that he was giving him a break but, I digress).
Apparently his safety/logs told him it was OK to run "Line-5" (Personal Conveyance) from a drop to a rest area. The regs are pretty clear about what are legitimate uses for L5. Moving equipment isn't one of them.
I'm surprised that Safety/Log Departments are advising drivers to use this.
The way yu describe your situation is a little confusing though:
use off-duty driving at the end of my shift to go from the truck stop to the customer Go to the customer to DO WHAT? Drop your empty to get loaded? If you are UNDER DISPATCH (that is, you are going to the customer to get a load which you will then take elsewhere), then this will be a log falsification.
he said to go to the customer do your post trip then go off-duty driving to the truckstop then the next morning go off-duty driving to the customer and then start your log whenever you're at the customer
Now I'm even more confused. You are already AT the truck stop on a break - you drive TO THE CUSTOMER on L5, go ON DUTY TO DO A POST-TRIP (pre/post trips are ON DUTY (not driving)), go BACK ON L5 to the truck stop, then drive BACK TO the customer from the truck stop on L5?
Again - if you are under dispatch - each time you make a move and change your duty status - is an individual instance of log falsification. Going on duty to do your post trip at the customer - means your 10 hour break is BROKEN and the 10 hours do not start, until you are back off duty again. Not logging the post trip, or logging it off duty, is ANOTHER LOG FALSIFICATION. I'm counting like 3-5 log falsificaitons in the scenario you just described.
But I get the feeling you're just not describing it correctly - as it is too screwy to contemplate.
WHY would you leave the truck stop - to make an OFF DUTY ROUND TRIP to the customer, then go back in the morning on L5 - and start your clock there? That's both really weird, and totally illegal.
Please try to describe the situation a little clearer - and is my take on it is correct - I got my laugh/head shake for the day in.
Patrick pretty much nailed it.
