Nope. You get in your sleeper and take a nap or hang out at the truck service center lounge or whatever. Technically you are not working, so you are not on duty.
Let me clarify this a bit for ya a break down wont count against ur 70 if the company does or pays someone to do the work, but if for chance ya get with one the backwoods small companoes that have the driver do the work which is rare anymore it will bc ya gotto be on duty not driving.ya wont have to worry bout that tho bc the bigger and most small compnaies do the work now. it will count agaunst ur 14 hr rule tho.
Let me clarify a bit. If your at a shop getting the truck fixed then it does not count against the 70 hour rule.....
Now with that being said if you are broke down on the side of the road then yes it counts against your 70 cause you are still in full controll of the truck and you are responsible for it. Waiting for a repair truck to show up weather its tire change or something bigger legally you have to remain On-duty Not driving till the repairs are completed. If you try to show yourself in the sleeper while waiting for the repair truck DOT will have a problem with that.
