Sorry to hear that, Simon. You can get more definite advice if you fill in the blanks, though.

  • What company?
  • What was the accident (fender bender or did you jackknife a truck)?
  • What is the contract all about: employment or school financing?

Us Xpress... Non compete clause... An Yr contract to pay off my loan.. Almost roll over accident.. Failure to Maintain control.

Read the contract. Mine specifically stated how much i would owe at what point of employment i seperated... whether i quit or was terminated.

non compete sounds as though you need to pay off that loan before going elsewhere.

did you ask to go back with a trainer?

Hi Simon, I was in a similar situation years ago, different field.

As far as I can remember, it's been a long time so don't quote me, even if you signed a non compete contract, if it is the company that terminates you, they can not prevent you from going some other place to make a living for yourself and your family, it is your right.

Obviously YMMV and all that, but there is a gray area there, the question is can you afford to fight this company in court if it gets to that.

Read your contract to determine your current obligation to USX.

Although they cannot stop you from working for another company, they can however hold your training certificate until all your financial obligations are met. Until they release your training certificate, your are virtually unhirable as a driver.

Read your contract, the one you signed.

Thanks Paul an G-Town...yes i gotta read it again but true they can't stop me from making a living...yes my financial is still my obligation an ibcan still get my certificate...
