Sorry Brett, I should of used different terminology. You're right, it is not "illegal"... what I should of said instead is "per MANY company's policy procedures, sleeping in the top bunk when truck is moving is NOT ALLOWED."
That being said, I concur with Starcar's last post, e.g. with all the mundane rules the "authorities" are cramming down the throats of carriers and truck drivers, it is surprising (maybe not?) that sleeping in the top bunk of a moving truck has not been made illegal.

Its a company policy as Brett stated.. Swift doesn't allow top bunks sleeping, while the truck is in motion. tho some trainers dont want to share their bed space with another person. (don't blame them) and the new trucks (like mine) come with a restraint system on both bunks. When I was in training, my trainer had be sleep on the top.. It was hard to get use to it, with the fear of falling/being squished came to mind. Mine never had the restraint system for the top. Just "be prepared" (Boy scout motto) for anything.
