Unfortunately, that (driving from customer to parking location) is not a permissable useage of personal conveyance. We have to do as I described in my previous post in this thread. You don't have to take my word for it, just read the HOS rules....that is what I did. Not exciting reading, but we need to know the rules that apply to our industry so we can deal with them properly.

If you're forced to leave, I would suggest going to the off duty driving line and documenting it thoroughly. Send a message to dispatch, and to the log department. Then, proceed directly to the CLOSEST parking area and complete your break, and hope thatin the next 7 days you either don't get pulled into a chicken coop, or that you get an understanding officer.

The FMCSA has recently removed the "empty"/ "unladen" and "short distance" wording from the off duty driving guidance.

Dispatcher, Fleet Manager, Driver Manager

The primary person a driver communicates with at his/her company. A dispatcher can play many roles, depending on the company's structure. Dispatchers may assign freight, file requests for home time, relay messages between the driver and management, inform customer service of any delays, change appointment times, and report information to the load planners.

Hours Of Service

HOS refers to the logbook hours of service regulations.

Not trying to argue with you. However common sense would hopefully prevail. Providing you can show that the reason you moved was because you were chased off the property, and were not actually trying to progress the movement of the load

I agree with that, certainly. My point is that you cannot do it in PC mode....you just have to drive in violation and explain it. I am guessing that improper use of PC could get us in more trouble if discovered by DOT - they would likely see it as though you were trying to hide the fact that you were driving in violation. Also, in my case, my company would likely take PC away from me. We are fortunate to have personal conveyance as an option, but if we misuse it, they disable it for 6-12 months. Many companies just don't permit it, period.

DOT:

Department Of Transportation

A department of the federal executive branch responsible for the national highways and for railroad and airline safety. It also manages Amtrak, the national railroad system, and the Coast Guard.

State and Federal DOT Officers are responsible for commercial vehicle enforcement. "The truck police" you could call them.

If a guard forces to move to a different location and this move would cause you to violate your clock, be sure to ask said guard for his badge number and maybe his company name to back up your claim about the forced move.

Maybe that little bit of intimidation could convince the guard to let you be.
