Look Big White...you actually increased the risk by antagonizing them. BS called. Not buying into it one bit.
Take your story to FHP. We are of no help to you.
The lawyer isn’t interested because there is no money to be had. Sad to say but without an injury it isn’t worth their time.
Criminal charges is probably your only option.
Waving that camera and then telling us about it like you had really done something makes it sound like you were being either aggressive or confrontational.
If you want Morgan & Morgan to take this case you should have let the trucker run you over and cripple you for life. They would have jumped all over that. There's no money in pursuing this kind of stuff.
Big White wrote: "Dont worry, I wont hold anyone lia le for acting like an attorney or otherwise"
Then he jumped on me for my response. typical immature "you arent saying what i want to hear" behavior. I assumed NOTHING. You called Morgan & Morgan, a personal injury attorney in civil litigation. They have nothing to do with criminal prosecution. Anyone who watches Law & Order knows that, and a retired officer would definitely know that.
I was pointing out what the defense would claim. and YES you did leave the scene of an accident and you chased someone for miles. By your description, you did not just follow him, you pulled in front of him showing him the camera to say in your words "as I got a few feet ahead of him, i waved my camera I got you now". You taunted him like an immature child. If you truly only wanted to record his info to report him, you wouldnt have pulled up along side him in his blind spot (this part made me laugh cause our mirrors are very good, and blind spots are limited. you didnt sneak up on him I had worse blind spots in my car lol) How did you wave your camera out the window in a safe manner and drive at the same time? YOU put yourself and others in danger just as badly as he did.
if he is guilty of aggravated assault, you are guilty of reckless endangerment.
if you are retired law enforcement in Florida, the same state in which this happened, why are you asking us?
Operating While Intoxicated
You said "So because FHP or Sheriff were not responding to my calls, I decided to move in closer to get a video of the Trailer plates, DOT#, etc. So I got up close to him on the right, because I knew his vision would not be able to easily see my vehicle from this angle. I made my video, and then as I got a few feet ahead of him, I waved my camera out the window, like "I got you now". His train horn went off again. Then he quickly got right on my bumper yet again (on video). So I decided to speed up rapidly and move to the far left lane, and then brake to get behind him once again. Well, that didn't work, as he was prepared. His engine damn sure has the power! So now he swerves over and runs me off the road again, this time on video."
This in itself says you were being confrontational. No-one here blames you for being mad about it but the responses I read from others and your replies to them leads me to believe you are being confrontational with us because you didnt like our replies. You can keep on but the replies you get will not improve. Call the company he works for and it should be handled. We as professional truckers are taught to not react to instigators on the road, as it only makes an already bad situation worse.
A department of the federal executive branch responsible for the national highways and for railroad and airline safety. It also manages Amtrak, the national railroad system, and the Coast Guard.
State and Federal DOT Officers are responsible for commercial vehicle enforcement. "The truck police" you could call them.
Respectfully, if Morgan won’t take the case,
...... really why would they were was the potential payout based on some real damage to you or your truck. No defence for this type of driving, but the driver needs to be charged and adjudicated, there is no civil payout for you. Put your efforts in getting the DA to prosecute this driver
cheers
So you chased this guy from North of Ocala to Tampa? You waved a camera at him/her. Oh and I suppose you were videoing with your phone in your hand while driving too.
Just incredible. Stop trying to play what I call "the ghetto lottery". There are no winners in that game. Next time you could be seriously hurt.
So you encountered an aggressive driver and probably did something to make them mad at you, before this whole scenario. We're they in the right? Nope. We see ****tards like that daily, who really needs their license revoked. But we also see 4 wheelers doing incredibly stupid things daily also, that probably don't need a license either.
Good luck with those criminal charges or civil suit, or whatever it is you're trying to accomplish.
No Susan....he followed him.. not chased him.
a truck he claims was driving 85 mph...he followed him 100 miles after being pushed off the road. which means how fast was he going to catch up to him?
and he didnt leave the scene of an accident.. he followed the speeding and aggressive truck but only after getting witness statements?
oh, and i wonder how well it will go over "i called the FHP 100 times and so did witnesses but the police never showed up. they suck, now arrest that guy" hahahhahhaha
he sounds paranoid. the 2 truckers were friends, the one truck swerved to pretend to get on the turnpike, and the PD doesnt want to help.
Are aliens landing soon too?
So I got up close to him on the right, because I knew his vision would not be able to easily see my vehicle from this angle. So, after being run off the road by him once, you chose to pass him then slow down and get behind him again...giving him the chance to run you off the road two more times (once when you passed him and again when you slowed down to get back behind him) doesnt seem like you were very afraid of him now does it.
So most of us 4 wheelers decided to move over to the far left lane, to avoid this idiot. Upon my doing the same, I looked in left mirror and noticed another very fast approach by another semi. This is not a "no left lane" area for trucks, that I am aware of anyway. This oncoming truck has probably 30-40 car lengths behind me, so I proceeded to far left lane.
So you got into the passing only lane and stayed there? Yes, its a passing lane for four wheelers also and as you stated he had the right to pass slower traffic in the left lane as it was not a no trucks in the left lane section of road.
I think I might have to call BS on this story. Without seeing the video evidence I think you may have been the instigator (I know if I were run off the road by a truck I wouldnt give him 2 more chances to run me off again) and was trying to make some money off some poor trucker out there. I dont even know if I would trust your video since you didnt film from the first incident. Post your video for posterity. You wont be able to make any money off this case but you might be able to get a trucker in trouble. If he was really in the wrong as you claim, call his company as he doesnt need to be on the road driving like that, if you were trying to get a payout, let it go.

All together a bizarre encounter, but to say anybody here is protecting or defending the guy is certainly not the case.
Also, , "I waved my camera out the window, like "I got you now". Didn't make the situation any better.
