In 2009 I was convicted of a marijuana charge in texas I have a georgia cdl.. I went to renew my cdl but ga said I have a hold on my cdl in texas so I called Texas and they say my cdl is disqualified in texas for life..can I still renew my georgia cdl

CDL:

Commercial Driver's License (CDL)

A CDL is required to drive any of the following vehicles:

  • Any combination of vehicles with a gross combined weight rating (GCWR) of 26,001 or more pounds, providing the gross vehicle weight rating (GVWR) of the vehicle being towed is in excess of 10,000 pounds.
  • Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing another not in excess of 10,000 pounds.
  • Any vehicle, regardless of size, designed to transport 16 or more persons, including the driver.
  • Any vehicle required by federal regulations to be placarded while transporting hazardous materials.

That will be up to Georgia. If I was a betting person, good chance GA will not renew. But that is based upon just a gut feeling. It seems to me that what 1 state does, will be followed by others.

Keep in mind that is not based upon any facts. The only thing I can tell you is call GA and get the answer from them.

Wonder if the disqualification will shadow you if you change it to another state....like NC.. ?? i'm not sure, theres someone else who has a disqualification from GA on a DUII charge, I think...so lets hope its just GA doing this...This is a great tho tragic lesson...the days of no one being able to find out what you have done are gone...be very careful, if you value your CDL...

If Texas is got your CDL on hold because of the drug charge and the ban for life then the hold will remain for life and no other state can touch it till Texas releases the hold statue.

That was the intention of creating the CDL in the first place - to prevent people from changing states when they get in trouble with their license. But it's still a very loosely-organized system and not all states recognize other states. In fact, in a lot of ways the entire system is going in the other direction. Many states don't allow simple CDL transfers into their state from another state at all anymore. They require you to take some or all of the testing over again and some states are even trying to require you to go through some sort of in-state schooling before you can test.

So to be honest, I'm not sure if you'll be disqualified from other states or not. First of all, I'm not sure if the law taking away your CDL for life is a Texas law or a Federal law. If it's a state law then the other states probably do not have to recognize it.

And last but not least, let's remember that everything revolves around money. You show up at Georgia or North Carolina's DMV with cash in hand ready to bring your license and residence into the state, well that's a lot of money for the state with license fees, income taxes, and everything else. If they turn you away they're turning away a lot of money. And Governments at any level aren't known for turning away revenue streams.

I would keep making phone calls and see what you can find out. If one state won't approve you, try another. As long as that wasn't a Federal law locking up your license you might be able to get back out there.

Dm:

Dispatcher, Fleet Manager, Driver Manager

The primary person a driver communicates with at his/her company. A dispatcher can play many roles, depending on the company's structure. Dispatchers may assign freight, file requests for home time, relay messages between the driver and management, inform customer service of any delays, change appointment times, and report information to the load planners.

DMV:

Department of Motor Vehicles, Bureau of Motor Vehicles

The state agency that handles everything related to your driver's licences, including testing, issuance, transfers, and revocation.

OOS:

When a violation by either a driver or company is confirmed, an out-of-service order removes either the driver or the vehicle from the roadway until the violation is corrected.

Sorry, but I am lost. Does a misdemeanor marijuana conviction mean you can't obtain a cdl?

He did not say if it was a misdemeanor or felony charge. I thought the point of the 1983 (I think that is the correct year) law was to prevent people from getting a CDL in one state if they had a CDL in another state. From what I have seen at the different places along the way of getting ready for school, they all can se that you have a CDL in one state or the other. If they can't, well to be honest that scares me. I don't want to be on the road with that driver that has 19 tickets on a license in TX but now has a GA license. Sometimes certain laws are a good thing. My bet for the OP, you going to have to get TX to release the hold.

Yes you will have to get the state of Texas to release the hold on the CDL.

As we have seen Georgia has some very definite ideas in regards to CDL when it comes to Dui/dWi and drug charges.

Best advice is to get out of Georgia and stay out. Only thing good about Georgia is......nope not even that.....so now no reason to stay.

Yea move to California and take you test there. It's given in over 40 different languages even though the law clearly states you must speak and read English well enough to communicate which to my way of thinking should also include the freaking CDL testing.

I swear one of these days we all will have a huge party and the banner above will read "California. ...times to remake the movie 30,000 leagues under the sea"
