Changing duty status to smoke a cigarette, etc seems like splitting hairs.
However the rules are clear, though I would never have considered it before reading this topic.
Only Log Sleeper-Berth Time IN Your Sleeper Berth
Question: Can I log sleeper-berth time if I am at a shipper or receiver? Answer: You can log sleeper-berth any time that you are resting in the sleeper-berth compartment of your unit. You cannot log sleeper-berth time if you are not in the sleeper berth compartment of your unit. Remember to log what you do and do what you log!
As far as home time we are required to use off duty with the remark arrive home
The customer who is shipping the freight. This is where the driver will pick up a load and then deliver it to the receiver or consignee.
The portion of the tractor behind the seats which acts as the "living space" for the driver. It generally contains a bed (or bunk beds), cabinets, lights, temperature control knobs, and 12 volt plugs for power.
Just join the day cab gang and get rid of the sleeper all together and you won't have to worry! No remembering to change your status or having a DOT officer following you back from the urinal to make sure your hands are clean and that you are in the proper status.
A tractor which does not have a sleeper berth attached to it. Normally used for local routes where drivers go home every night.

State and Federal DOT Officers are responsible for commercial vehicle enforcement. "The truck police" you could call them.
Operating While Intoxicated
Ok smart a$$ question but if you are sitting in the driver's seat and log your self in the sleeper berth aren't you immediately in violation?
Do you have to enter the sleeper berth area and reach back to your Qualcomm unit before you can log yourself in the sleeper berth?

Good question; but that's REALLY splitting hairs.. almost LITERALLY, when you get yours stuck in the gear shifter as you grab for the QC/ELD, from the bunk ... omg ... haha!
Glad my driver/hubby is a daycabber, as well~! Sure with Bobcat Bob on THAT one, LoL~!

Why don't you call your company and ask?

Clearly the topic of this thread would apply to all drivers subject to D.O.T. logging regulations, not just one company.

Delve Dave, sometimes DOT WILL pull into truckstops or rest areas to check for these type violations (ie falsification of logs).
To cover myself anywhere inside the cab, I pull the FRONT CURTAINS lol.. that makes the seats part of the sleeper. However, if I get out of the truck, yes I change it to off duty. I'm telling you, sometimes whether you realize it or not, they're watching you.
So Rainey/Kearsey has seen them "harrassing" drivers who are parked also.
It HAPPENS! Don't take any chances because the ticket will go to YOU, the driver... not to your company.

Thanks Susan, I appreciate the info and I like the front curtain trick making the whole inside a sleeper.
I wonder how many people have gotten cited in emergency bathroom situations! Hopefully the DOT officers have some mercy on people who are honest and sincere under those circumstances

A friend was woken by DOT. He was on sleeper and jumped in the front seat to open the door and speak to the officer. The cop was annoyed he was parked on a rest area ramp which clearly had no parking signs. My friend got nasty with a "you woke me for that???? ". Immediate violation ticket. When he went from sleeper to the front to speak to the officer he didn't switch to "on duty". The officer said he should have turned on the QC and switched before talking to him.
So be a smart ass and you will get a ticket.
"On duty" also includes communication with dispatch. So the officer went through the QC messages and saw he was messaging. Dispatch while in "sleeper". Another violation.
Know the rules and do your best. Most DOT wont care about this type of stuff but get an attitude and you will get one back

Dispatcher, Fleet Manager, Driver Manager
The primary person a driver communicates with at his/her company. A dispatcher can play many roles, depending on the company's structure. Dispatchers may assign freight, file requests for home time, relay messages between the driver and management, inform customer service of any delays, change appointment times, and report information to the load planners.
