Get CDL In One State W/ 2 DUI In Other State

Got a DUI conviction in 2009 & another in 2016. Both in personal vehicle in OR. went thru all the programs, blower, etc. Got my CDL fully reinstated, been driving truck this whole time. Now, Aug 2021, DMV says they're going to suspend my CDL for Life!! I'm 65, drove truck my whole life, never did any other type of job/work. If, in fact, they can really do this; can I get my CDL in another state before the suspension?

CDL:

Commercial Driver's License (CDL)

A CDL is required to drive any of the following vehicles:

  • Any combination of vehicles with a gross combined weight rating (GCWR) of 26,001 or more pounds, providing the gross vehicle weight rating (GVWR) of the vehicle being towed is in excess of 10,000 pounds.
  • Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing another not in excess of 10,000 pounds.
  • Any vehicle, regardless of size, designed to transport 16 or more persons, including the driver.
  • Any vehicle required by federal regulations to be placarded while transporting hazardous materials.

Dm:

Dispatcher, Fleet Manager, Driver Manager

The primary person a driver communicates with at his/her company. A dispatcher can play many roles, depending on the company's structure. Dispatchers may assign freight, file requests for home time, relay messages between the driver and management, inform customer service of any delays, change appointment times, and report information to the load planners.

DMV:

Department of Motor Vehicles, Bureau of Motor Vehicles

The state agency that handles everything related to your driver's licences, including testing, issuance, transfers, and revocation.

What reason did they give for this? Since States link to other States, you probably can't.

Sure they can. They make it pretty well known that DUI convictions can and will lead to a lifetime suspension. A CDL is federally regulated. If I get a speeding ticket in New Jersey, it still dings me even though I live in Pennsylvania where before it would just disappear.

Maybe contact a lawyer, but I don't see them being able to help because you already have the DUI convictions.

The Substance Abuse Professional (SAP) is a person who evaluates employees who have violated a DOT drug and alcohol program regulation and makes recommendations concerning education, treatment, follow-up testing, and aftercare.

Thats odd that you'd be receiving a letter informing you that you're disqualified for life 5 years after the fact. Did this case just finally get settled?

Unfortunately for you there's no way around it. You may be able to get on being a yard dog somewhere as those don't require a CDL as long as you're not on public roadways.

For those new to trucking alcohol can seriously harm your career. Most companies have a zero tolerance policy for alcohol on the road. If you have even a trace on your breath you will be put out of service for 24 hours and your company will likely terminate you. DUI is anything over .04 in a CMV and if convicted your license is suspended for 1 year even if its in your personal vehicle. I believe you also need to complete a SAP. If you get another DUI you're disqualified from holding a CDL for life. They're far more strict on current CDL holders than those entering the industry and rightfully so. We're professional drivers and need to conduct ourselves as such.

  • Is designed or used to transport 16 or more passengers (including the driver) not for compensation
  • Is designed or used to transport 9 or more passengers (including the driver) for compensation
  • Is transporting hazardous materials in a quantity requiring placards

HOS:

Hours Of Service

HOS refers to the logbook hours of service regulations.

If you're 65, been driving your whole career, etc., how do you wind up with not one, but two DUI convictions in the last 12 years?

Sorry, but I cannot be non judgemental at this point with the OP's story.
