Drug Testing PRIOR To CDL

I've had my CDL for a little over a year now. I've worked for 3 different companies during this time period all where good to go no issues. I went thru a DOT check point yesterday, and the office is stating that in his system I am not a licensed CDL operator. Because I had a failed drug test while I was in crane school and getting my CDL. I have since passed many test including the one for crane school. I have my hazmat as well. Now I have been clean from maryjane for going on 2 years. But they are saying I need to attend rehad to get my license back. Has anyone heard of this? Why would a test i took before receiving my CDL effect me now.

CDL:

Commercial Driver's License (CDL)

A CDL is required to drive any of the following vehicles:

  • Any combination of vehicles with a gross combined weight rating (GCWR) of 26,001 or more pounds, providing the gross vehicle weight rating (GVWR) of the vehicle being towed is in excess of 10,000 pounds.
  • Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing another not in excess of 10,000 pounds.
  • Any vehicle, regardless of size, designed to transport 16 or more persons, including the driver.
  • Any vehicle required by federal regulations to be placarded while transporting hazardous materials.

HAZMAT:

Hazardous Materials

Explosive, flammable, poisonous or otherwise potentially dangerous cargo. Large amounts of especially hazardous cargo are required to be placarded under HAZMAT regulations

DOT:

Department Of Transportation

A department of the federal executive branch responsible for the national highways and for railroad and airline safety. It also manages Amtrak, the national railroad system, and the Coast Guard.

State and Federal DOT Officers are responsible for commercial vehicle enforcement. "The truck police" you could call them.

You probably need to contact clearing house

Not ever having had done drugs, so I didn't have to worry about it while in school for my CDL, did the school record it on the Clearing House while you had a CDL permit? You would have had to sign into the Clearing House at the beginning of the year, what did it say?

If you didn't really look at it, you will need to go to the Clearing House to see what it says. It's quite possible that he pulled up somebody else with a very similar name who may have had their CDL tagged. I would think when you changed companies those three times that they did a background check on you, but not all companies do, especially if they are small. I drove for a company that did not do a background check and they had a driver who failed a drug test at another company, did not go through the SAP program, hired on with my company and drove for them from May 2015 through November 2016 when he was involved in a fatality accident....all without a CDL. He was doing cocaine but said he hadn't done anything for a couple days before the accident. Never did find out what his drug test turned out to be. He had been driving 17+hours when he hit the car....so hard telling. He did get his CDL pulled permanently.

Good for you for being clean and staying clean. So I would start with the Clearing House:

If there is nothing listed, then have your company help you with this DOT inspection to get it cleared up.

Federal Motor Carrier Safety Administration

The FMCSA was established within the Department of Transportation on January 1, 2000. Their primary mission is to prevent commercial motor vehicle-related fatalities and injuries.

  • Data and Analysis
  • Regulatory Compliance and Enforcement
  • Research and Technology
  • Safety Assistance
  • Support and Information Sharing

SAP:

Substance Abuse Professional

The Substance Abuse Professional (SAP) is a person who evaluates employees who have violated a DOT drug and alcohol program regulation and makes recommendations concerning education, treatment, follow-up testing, and aftercare.

DOT:

Dispatcher, Fleet Manager, Driver Manager

The primary person a driver communicates with at his/her company. A dispatcher can play many roles, depending on the company's structure. Dispatchers may assign freight, file requests for home time, relay messages between the driver and management, inform customer service of any delays, change appointment times, and report information to the load planners.

HOS:

Hours Of Service

HOS refers to the logbook hours of service regulations.

It very well could be a possibility that someone has the same name as you, and they are seeing their record?

I had this years ago, I applied then to be a mixer driver, for a big company. Friends drove there 20+ years and made great money. So they said after a license check, I had an accident on my record?!?! I've had my So.Calif lic. since I was 16, and NEVER had an accident in my life ! Turns out some guy in North Calif had this crash @7;30 am, in a city I had NEVER heard of until then!

I spent the day back and forth with the Cali DMV , and the Sheriffs office up north, getting no where. The ticket was archived elsewhere, since it'd been a couple years prior. All my DL records checks NEVER showed this up. The guy had the same first / last name, and exact birthdate. BUT his middle initial was an "L", when mines an "M", and his drivers lic was from Colorado, NOT Calif !

DMV refused to admit someone was a moron and input the info into the wrong file, and would not fix it in their systems. And I sure as heck wasn't driving all the way north to even try to deal with the Sheriff's office. I just forgot about it and let in fall off the system....

And recently here in Philippines, an older Filipina woman was going to the US for her first time. Well, Manila's airport immigration held her up, pulled her aside to a supervisors office, to check her ID out better, for this same reason. Someone with her exact name was red flagged. Luckily they figured it all out so she made her flight on time....
