I was in an accident no major damage to the other truck(pick up truck) missing mirror cover and passenger fender damage. I signaled to indicate that I'm going to change lanes. I proceed to change lanes and while changing lanes the truck tries to speed around me to pass. I'm already committed to the lane so he slows down and I speed up and then he speeds up and my trailer took the mirror cover and caused fender damage. We pulled over and I looked at the damage and I didn't say anything but he admit he slowed down and flashed his light at me. I assume that he was letting me over since he flashed his lights. Overall a officer gave me a ticket for improper lane change and gave him a warning because his license was expired. I want to know how many points will be on my record and will this effect when I apply for another job? I'm not saying I'm going to get fired but just to get another job. I also waited a few seconds before I got so I didn't just abruptly changed lanes.

Dm:

Dispatcher, Fleet Manager, Driver Manager

The primary person a driver communicates with at his/her company. A dispatcher can play many roles, depending on the company's structure. Dispatchers may assign freight, file requests for home time, relay messages between the driver and management, inform customer service of any delays, change appointment times, and report information to the load planners.

First off your safety dept needs to get the crash report and go over it with you for accuracy. Things don’t sound right here the way it is written. It doesn’t appear to be a DOT reportable so that is good.

IF you had safe clearance at the start of the lane change then the rest makes of the other drivers actions really make no difference as to fault.

All states set their own points systems for violations. That question needs to be asked of the court or drivers license agency.

I would certainly fight the ticket if you had clearance at the start of the lane change.

The other driver having an expired licesne really has no bearing on this, it isca collateral issue not a reason the crash occurred. That was the ofgicers discretion.

DOT:

Department Of Transportation

A department of the federal executive branch responsible for the national highways and for railroad and airline safety. It also manages Amtrak, the national railroad system, and the Coast Guard.

State and Federal DOT Officers are responsible for commercial vehicle enforcement. "The truck police" you could call them.

A friend of mine had a similar accident. He was on duty creeping into a lane merge section. He did not receive a ticket. A year and a half later, he applied for another job and was told there was "extensive medical paid" and since it was an injury involved accident, he has to wait 2 to 3 years switch companies. Be aware people can file injury claims later.

His company never even told him about the injury. They just paid it. And he was "on duty" so going less than 5mph. How much injury could there be with no vehicle damage?

And seeing all the billboards out there for lawyers that handle accidents with big rigs !! There's always been accident "scammers" looking for easy pay days from fake accidents.....

Back in 1979-80, my co-worker/boss @ a plating company, got involved with that type of crash scam group. He drove a '72 Pinto hahaha, be in a certain spot, a certain time and purposely get rear ended. He had his wife, small daughter, a preggo sis in law. They all got paid, he used his proceeds to make a down payment, and buy a house! Lucky his Pinto didn't explode from impact *SMH*

He asked me if I wanted to make easy money doing the same crap, he could "hook me up" Of course I refused, duhhh told him it'd be my luck, I'd probably get disabled, paralyzed or worse dead....NO THANKS AMIGO

Funny you mentioned this, yesterday I noticed a billboard from "The hammer" Mr. Isaacs that said to call him if you are injured by a truck on ice. Pretty sure it was referring to the Werner case.
