And that's a reason I love being paid hourly. I'm getting paid from time on to time off duty. Sitting in traffic, breaks, etc. Not trying to brag but it's pretty awesome.
That's funny right there. California has an almost non existing economy, almost unless road department amoung other major issues and yet people are worried about the $5 dollars they may or may not recieve for lunch.

The article claims that CA law requires paid 30-minute breaks per every five hours of shift. This is incorrect; these breaks don't have to be on the clock (except in specific circumstances), although some employers choose to pay for them. Only the ten-minute breaks in CA must be paid. I live in CA and have never been paid for my lunch breaks. Frankly, it's nice to live in a state that requires breaks at all, paid or unpaid. When I lived in Montana, I would often work 10-12 hours with my only "break" being two minutes in the restroom.
When a violation by either a driver or company is confirmed, an out-of-service order removes either the driver or the vehicle from the roadway until the violation is corrected.

I agree 100%. There's another great aspect of getting paid by the mile that's even more important. Keeping those wheels turning is how everyone makes money....the company and the driver. So your interests are aligned. You both want the same thing.
When you're working hourly or salary, it's like a tug of war. The company would benefit the most by working you to death so they can get the most for their money. The employee benefits the most by doing as little as they can so they're making more money for less work. You both want opposite things.
So it's great knowing that when you're not getting the miles you were hoping to get, the company isn't happy about it either. They want to see you rolling just as badly as you want to keep rolling. You're a true team in that respect. You'll sink or swim together.
