In a situation like this, I am sure most companies will not blame the driver because it was a mechanical issue with the equipment. Although they would probably caution you about checking the reefer a little more often in the future.
As far as what would I do, I would call dispatch & alert them to the issue & let them tell me what they want done. Because it is Walmart, and it is just outside the temp range required, I am pretty certain they will not take the load because of the possible liability of folks getting sick from eating it. Just my 2 cents worth.
Then after you get done with this load, you would need to get the reefer fixed before going onto the next load.

Ernie...you made me feel a little better about my guess at the question! And for that I thank you! lol

At Navajo, I would have to contact OS&D and find out what they want me to do.

To bad it's not a load of chicken, you could just leave the trailer at the truckstop.
Let me throw my 2 cents in here
First I want to check my Qualcomm and see if I got a performance alert as to when/if I got a refer alarm to try and pin point when my temperature went out of range. Next I'll call my FM and get him/her up to speed of the situation and see how they want to handle it.
But let's say I called and couldn't get a hold of my FM cuz they were at lunch or something. Either way I'm now rolling down the road against my governor and calling my claims dept and letting them know of a possible claim coming. Hopefully they will get a hold of Wal-Mart to make sure I have a door ready as I'm still roughly 30 mins from the location. Maybe claims will have insight.
Now let's day my company's phones are down and I don't have FMs cell number. Now I'll call Wal-Mart and let them know my refer just went down and the temp is climbing. Hopefully in the 30 mins it's gonna take to get there, they can have a door ready. I believe I have a responsibility to let Wal-Mart know of the situation as we're talking about product for human consumption so no way am I gonna just hope someone at Wal-Mart doesn't catch the temp. If that were to happen and ppl got sick, they could trace to product back to its delivery and then a would be claim turns into a lawsuit.
Either way I can't take my preplanned load as I have to get the refer fixed.
So now we know where the discount stores get their yogurt.
My guess would be that it just recently went out of temp since nobody called me (I know Prime gets the alarms). So I would bet the product is still in range and I'm sure walmart will temp random cases to be sure. I would deliver as planned and get trailer fixed after.
My apologies for completely being a ghost on this thread. I was just on Hometime and went out of town for a few days on a fishing trip, going for Salmon. And I was just enjoying life way too much to be on the Internet.
Thanks Guyjax for answering the question. All of the answers above are exactly what I was planning on saying. Thanks guys! I hope you all enjoyed this one! Now back to thinking of another one!
I would deliver it. Theres already a load preplanned for you and I also think the temperture would hold out until you arrived. You can get the reefer fixed afterwards.

If it was the drivers fault? Maybe. It's always a possibility. But if not your fault you are good
