DUI In CA With FL Drivers License, Can I Still Get My CDL?

Hello Truckers, This was probably asked before on here but the posts I found were for DUI's in the same state the drivers license is in. Anyways, I was convicted of a DUI in the state of CA, but my drivers license is from the state of FL. At the time of my arrest and after my court dates and all the crazy fines I had to pay, at no point in time was my license ever suspended or revoked. Now my question is, am I eligible to get a CDL? My time here in CA is coming to an end as I will be Ending my active service here and moving back to FL. My job is a motor transport operator and would like to continue driving in the civilian work force.

CDL:

Commercial Driver's License (CDL)

A CDL is required to drive any of the following vehicles:

  • Any combination of vehicles with a gross combined weight rating (GCWR) of 26,001 or more pounds, providing the gross vehicle weight rating (GVWR) of the vehicle being towed is in excess of 10,000 pounds.
  • Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing another not in excess of 10,000 pounds.
  • Any vehicle, regardless of size, designed to transport 16 or more persons, including the driver.
  • Any vehicle required by federal regulations to be placarded while transporting hazardous materials.

Unfortunately you're probably going to be looking for work in a different industry. None of the major companies will hire anyone with a recent DUI. You could try like crazy to get some pre-hires with smaller companies or owner operators and pay for Truck Driving School yourself. But even that's a longshot. Getting a DUI and then trying to get into trucking is about as difficult as a child molester trying to get a job at a daycare center. It's about the worst thing you can do in the eyes of the industry.

For anyone that's unfamiliar with the pre-hire process we have an excellent article that will help you Understand Pre-Hires.

Look around on Craigslist. There are a lot of small companies and owner operators that advertise jobs there. Make some calls and see what they say. But it's going to be a tall order trying to find work in trucking for a while - probably 5-10 years.

The state that a DUI was received in doesn't matter, it will show up on your driving record. You are eligible to obtain a CDL , but it might be hard to find a job, depending on the age of the DUI. How long ago was it?

CDL:

It is still somewhat recent. It happened in March of 2013

You might have to wait until March of 2016. That will be three years, and it's the earliest most of the largest trucking companies will consider you. Some require 5 years old, some require 10, some say no DUIs in a lifetime. I would still call and ask as many companies as possible, you never know. Policies can change and exceptions can be made. If you have no luck there, look into local companies. You might find a company that's willing to overlook it if your driving and criminal record is otherwise clean. If nothing else, you should only have to wait a little over a year.
