Can My Wife And I Drive As A Team As Non-employees?

My wife and I would like to get out CDL and drive for 5 years. However is it possible to drive as a team for a company and just get 1099's at the end of the year and file our own taxes? We do not need health insurance or retirement 401K's? We do not want to be owner operators, just drive and make as much money as we can in 5 years.

CDL:

Commercial Driver's License (CDL)

A CDL is required to drive any of the following vehicles:

  • Any combination of vehicles with a gross combined weight rating (GCWR) of 26,001 or more pounds, providing the gross vehicle weight rating (GVWR) of the vehicle being towed is in excess of 10,000 pounds.
  • Any single vehicle with a GVWR of 26,001 or more pounds, or any such vehicle towing another not in excess of 10,000 pounds.
  • Any vehicle, regardless of size, designed to transport 16 or more persons, including the driver.
  • Any vehicle required by federal regulations to be placarded while transporting hazardous materials.

Owner Operator:

An owner-operator is a driver who either owns or leases the truck they are driving. A self-employed driver.

Exam Expedited hires husband/wife teams to drive double sleeper straight trucks as 1099 drivers. No taxes, no health benefits. 5 weeks out, 1 week home. There are a bio-medical transporter - human organs, plasma, and research related items so you must have your HazMat endorsement. The money is only $1000 per week, tops. It's more like $750.

HAZMAT:

Hazardous Materials

Explosive, flammable, poisonous or otherwise potentially dangerous cargo. Large amounts of especially hazardous cargo are required to be placarded under HAZMAT regulations
